How To Obtain Information ?

Information is any material in any form. It includes records, documents, memos, e-mails, opinions, advices, press releases, circulars, orders, logbooks, contracts, reports, papers, samples, models, data material held in any electronic form. It also includes information relating to any private body which can be accessed by the public authority under any law for the time being in force.

Application: A citizen who desires to obtain any information under the Act, should make an application preferably in the form "A" to the Public Information Officer of the Commission in writing in English or Hindi or in the official language of the area in which the application is made. The application should be precise and specific. The applicant should make payment of application fee at the time of submitting the application as prescribed in the Fee Rules. Subject to the provisions of sub-section (2) of section 5 or the provisions to sub-section (3) of section (6) of the RTI act, 2005, the Public Information Officer, on receipt of suh request under section 6 shall , as expeditiously as poosible, and in any case within thirty days of the receipt of the request ,either provide the information on payment of prescribed fees or reject the request for any of the reasons specified in sections 8 and 9 of the Act. Provided that where the information sought concerns the life and liberty of a person , the same shall be provided within forty-eight hours of the receipt of the request.

Appeal: Any person who, does not receive a decision within the time specified or is aggrieved by a decision of the Public Information Officer , may within thirty days from the date of receipt of the order of Public Inormation Officer , prefer an appeal to the Prinicipal Secretary, Law Department, Government of Sikkim, who shall be the Appelllate Authority under section 19(1) of the RTI Act, 2005 , which shall be accompanied by the prescribed appeal fee. The appeal may be made in the presrbied format (Annexure "E" of the Sikkim State Right to Information (Regulation of Fee,Cost and Miscellaneous)Rules,2005.

RTI COST/FEE Details

Application Fee to be paid by way of Bank Receipt to be deposited under Major Head 0070.Administrative Service Major Head:60-Other Services,118-Reciept under Right to Information Act 2005 in State Bank of Sikkim.. Application Fee can also be paid in cash to the PIO alongwith the application. In the form of Cheque/Demand Draft/Money Order/Postal Orderto the PIO

If application is made by email, money order/cheque/demand draft to the PIO for the application fee or send a copy of a receipt either by post, fax, PDF or in person.

Rs. 2.00 for each page created or copied (A3 or A4 size) plus postal charges. Actual charge or cost price in larger size paper plus postal charges. Actual cost or price for samples and models plus postal charges. Rs. 50.00 for each Floppy or Diskette. As per price fixed for the Publication available for sale, or photocopy charges of Rs. 5.00 per page.

First hour of inspection is free and Rs. 5.00 for each subsequent fifteen minutes or fraction thereof.

If the applicant belongs to Below Poverty Line (BPL) category, he/she is not required to pay any fee. However, he/she should submit a proof in support of his claim of belonging to BPL category.
